Where an order consists of multiple deliveries, the cancellation period begins when the final item is received.

To exercise your right to cancel, you must clearly notify Enable Access before the expiry of the 14-day cancellation period.

Terms and Conditions of Sale
These Terms and Conditions of Sale (“Terms”) govern the sale and supply of goods and services by Enable Access Ltd (“Enable Access”, “we”, “us”, or “our”) to any customer (“Customer”, “you”, or “your”). These Terms apply to all transactions conducted through our website, by telephone, email, quotation, purchase order, remote communication, or any other sales channel unless otherwise agreed in writing by a Director of Enable Access.
By placing an order with Enable Access, you confirm that you have read, understood, and accepted these Terms.
1. Definitions
For the purposes of these Terms:
Business Day means any day other than a Saturday, Sunday, or public holiday in England.
Consumer means an individual acting wholly or mainly for purposes outside their trade, business, craft, or profession.
Business Customer means any person, company, organisation, charity, school, local authority, NHS body, government department, sole trader, partnership, or other entity purchasing goods or services for business or professional purposes.
Goods means all products, equipment, assistive technology, software, components, accessories, spare parts, and materials supplied by Enable Access.
Services means any installation, training, configuration, consultancy, support, maintenance, assessment, survey, repair, or professional services supplied by Enable Access.
Contract means the agreement formed between Enable Access and the Customer upon acceptance of an order.
2. Application of These Terms
These Terms apply to all quotations, offers, orders, contracts, goods and services supplied by Enable Access.
Any terms proposed by the Customer shall not apply unless expressly agreed in writing by Enable Access.
No variation of these Terms shall be binding unless agreed in writing and signed by an authorised representative of Enable Access.
3. Formation of Contract
All orders placed with Enable Access constitute an offer to purchase.
A Contract shall only be formed when:
- Enable Access issues written acceptance of the order;
- Enable Access issues an order confirmation;
- Enable Access dispatches the Goods;
- Enable Access commences performance of any Services;
whichever occurs first.
Enable Access reserves the right to reject any order at its sole discretion.
4. Quotations
All quotations:
- Are provided in good faith.
- Are subject to availability.
- Are subject to confirmation.
- Are valid for 30 days unless otherwise stated.
- May be withdrawn prior to acceptance.
Quotations do not constitute a legally binding offer.
Enable Access reserves the right to amend quotations where there are changes in supplier pricing, taxes, duties, exchange rates, product specifications, transport costs or other factors outside our control.
5. Product Information
We make reasonable efforts to ensure that product descriptions, specifications, dimensions, photographs, illustrations and technical information are accurate.

Customers must satisfy themselves that products are suitable for their intended application before purchasing.
6. Suitability of Products
Enable Access supplies accessibility equipment, assistive technologies, mobility products, sensory equipment and associated services.
Any advice provided by Enable Access is offered in good faith based upon information provided by the Customer.
Unless expressly agreed in writing:
- Enable Access does not provide medical advice.
- Enable Access does not provide occupational therapy advice.
- Enable Access does not provide legal advice.
- Enable Access does not guarantee a product’s suitability for a specific application.
- Enable Access does not guarantee eligibility for grants, funding or support schemes.
The Customer remains responsible for determining suitability for their intended use.
7. Customer Responsibilities
The Customer is responsible for:
- Providing accurate information.
- Providing correct measurements and specifications.
- Confirming compatibility requirements.
- Ensuring products meet their needs.
- Reviewing quotations and order confirmations carefully.
- Notifying Enable Access promptly of any errors.
Enable Access shall not be liable for issues arising from inaccurate information supplied by the Customer.
8. Pricing
Unless stated otherwise:
- Prices are quoted in Pounds Sterling (£).
- VAT is charged at the prevailing rate where applicable.
- Delivery charges may apply separately.
- Installation charges may apply separately.
- Training and support services may be charged separately.
Prices displayed on our website may be amended without notice.
If a genuine pricing error occurs, Enable Access reserves the right to cancel the order and refund any monies paid.
9. Payment Terms
Consumers
Payment must usually be made in full before dispatch.
Business Customers
Unless agreed otherwise in writing:
- Payment is required before dispatch.
- Credit accounts are subject to approval.
- Credit limits may be reviewed at any time.
Invoices must be paid in accordance with the payment terms specified on the invoice.
10. Late Payment
Where payment is overdue:
- Enable Access may suspend performance of any contract.
- Enable Access may refuse further orders.
- Enable Access may charge interest on overdue amounts.
- Enable Access may recover reasonable debt recovery costs.
Business customers shall be liable for all collection costs reasonably incurred.
11. Delivery
Delivery dates are estimates only and are not guaranteed unless expressly agreed in writing.
Enable Access shall not be liable for delays caused by:
- Manufacturers.
- Couriers.
- Supply chain disruption.
- Import delays.
- Severe weather.
- Industrial action.
- Events outside our reasonable control.
The Customer shall ensure that suitable arrangements exist for receiving delivery.
Additional charges may apply where delivery attempts fail due to customer error.
12. Risk and Title
Consumers
Risk passes to the Consumer when the Goods are delivered.
Business Customers
Risk passes upon delivery.
Ownership of Goods remains with Enable Access until all sums owed have been paid in full.
Until ownership passes:
- The Customer shall store Goods safely.
- The Customer shall maintain Goods in satisfactory condition.
- The Customer shall permit recovery of Goods where payment remains outstanding.
13. Retention of Title
Enable Access shall retain full legal and beneficial ownership of all Goods supplied until:
- The purchase price has been paid in full.
- Any other sums owed by the Customer have been paid.
Where payment remains outstanding, Enable Access may recover Goods without prejudice to any other rights available in law.
14. Inspection Upon Delivery
The Customer should inspect Goods immediately upon delivery.
Any shortages, damage, defects or incorrect items should be reported as soon as reasonably practicable.
Failure to notify Enable Access promptly may affect the ability to investigate claims.
15. Consumer Cancellation Rights
Where a Consumer purchases Goods through:
- Our website;
- Email;
- Telephone;
- Video call;
- Any other distance selling method,
the Consumer may have statutory cancellation rights.

Nothing within these Terms affects any statutory rights available to Consumers.
16. Returns and Refunds
Returns, refunds and cancellations are governed by the Enable Access Returns, Refunds and Cancellation Policy.
Consumers and Business Customers have different rights.
Customers should review the Returns Policy before placing an order.
17. Bespoke and Special Order Products
The following products cannot generally be cancelled or returned:
- Bespoke products.
- Made-to-measure products.
- Modified products.
- Custom-configured products.
- Special-order products.
- Products sourced specifically for the Customer.
This restriction applies unless:
- The item is faulty.
- The item is not as described.
- A statutory right applies.
18. Warranty
Warranty cover is subject to the terms of the applicable Warranty Policy.
Warranty periods may vary by manufacturer and product.
Warranty cover generally excludes:
- Accidental damage.
- Misuse.
- Improper installation.
- Negligent handling.
- Unauthorised modifications.
- Water damage.
- Cosmetic damage.
- Normal wear and tear.
- Consumable items.
Warranty claims may require inspection before acceptance.
19. Installation and Site Conditions
Where installation services are provided, the Customer must:

- Obtain any necessary permissions.
- Ensure the installation environment is suitable.
- Provide accurate information regarding site conditions.
Additional costs arising from inaccurate information or unforeseen site conditions may be chargeable.
20. Surveys and Assessments
Any survey, assessment or recommendation is based upon information available at the time.
Enable Access reserves the right to revise recommendations, quotations or installation requirements where additional information becomes available.
21. Technical Support and Services
Enable Access will exercise reasonable care and skill in providing services.
Appointments cancelled with insufficient notice may incur cancellation charges.
Remote support services remain subject to technical feasibility and availability.
22. Software and Digital Products
Software supplied by Enable Access remains subject to the licence terms of the software owner.
Enable Access does not guarantee:
- Continuous operation.
- Compatibility with future operating systems.
- Ongoing support from third-party software publishers.
Software licences activated or downloaded may not be eligible for cancellation or refund.
23. Public Sector Orders
Where orders are placed by schools, colleges, universities, NHS organisations, local authorities, charities, government departments or public bodies, the person placing the order warrants that they possess the authority required to bind the organisation.
Internal procurement delays or funding issues shall not automatically entitle cancellation once a Contract has been formed.
24. Export Orders
Where Goods are exported outside the United Kingdom:
- The Customer is responsible for local regulatory compliance.
- The Customer is responsible for import duties and taxes.
- Enable Access does not guarantee compliance with overseas regulations unless expressly agreed.
25. Intellectual Property
All intellectual property rights remain the property of Enable Access or its licensors.
No rights are transferred except as expressly provided.
Customers may not:
- Copy documentation.
- Reproduce website content.
- Use logos without permission.
- Create derivative works.
- Remove copyright notices.
26. Confidentiality
Each party shall keep confidential any non-public commercial, technical or proprietary information disclosed by the other party.
This obligation shall continue after termination of the Contract.
27. Data Protection
Enable Access processes personal information in accordance with:
- UK GDPR.
- Data Protection Act 2018.
- Our Privacy Policy.
- Our Cookie Policy.
Customers are responsible for ensuring that any personal information provided to Enable Access is supplied lawfully.
28. Anti-Bribery and Ethical Conduct
Customers shall comply with all applicable anti-bribery and anti-corruption laws.
Enable Access may terminate any Contract immediately where bribery, corruption or unethical conduct is suspected.
29. Modern Slavery
Enable Access is committed to preventing slavery, forced labour and human trafficking.
Customers and suppliers are expected to maintain equivalent ethical standards.
30. Environmental Compliance
The Customer is responsible for complying with any applicable waste disposal, recycling and environmental regulations relating to products supplied by Enable Access.
31. Limitation of Liability
Nothing within these Terms excludes liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Breach of mandatory statutory rights.
- Any liability that cannot lawfully be excluded.
Subject to the above, Enable Access shall not be liable for:
- Loss of profit.
- Loss of revenue.
- Loss of contracts.
- Loss of savings.
- Loss of goodwill.
- Loss of business opportunity.
- Loss of data.
- Indirect losses.
- Consequential losses.
For Business Customers, total liability shall not exceed the amount paid for the relevant Goods or Services giving rise to the claim.
32. Force Majeure
Enable Access shall not be liable for any delay or failure arising from events beyond its reasonable control including:
- Acts of God.
- Extreme weather.
- Fire.
- Flood.
- Pandemic.
- Epidemic.
- War.
- Terrorism.
- Industrial disputes.
- Utility failures.
- Cyber-attacks.
- Government restrictions.
- Supply chain disruption.
33. Suspension and Termination
Enable Access may suspend performance or terminate a Contract where:
- Payment remains overdue.
- Fraud is suspected.
- Insolvency occurs.
- The Customer breaches these Terms.
- Continued performance becomes unlawful.
Termination shall be without prejudice to any accrued rights.
34. Insolvency
Enable Access may immediately terminate any Contract if the Customer:
- Enters administration.
- Enters liquidation.
- Has a receiver appointed.
- Ceases trading.
- Becomes unable to pay debts as they fall due.
All outstanding sums shall become immediately due.
35. Notices
Any notice required under these Terms must be sent by:
- Email.
- First-class post.
- Courier.
- Hand delivery.
Notices shall be deemed received when successfully delivered.
36. Complaints
Enable Access aims to resolve complaints fairly and promptly.
Complaints should be submitted in writing wherever possible.
A copy of our complaints procedure is available upon request.
37. Alternative Dispute Resolution
Before commencing legal proceedings, the parties shall seek to resolve disputes through reasonable negotiation and discussion.
Nothing prevents either party from commencing proceedings where necessary to protect their legal rights.
38. Severability
If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
39. Waiver
Failure by Enable Access to enforce any provision shall not constitute a waiver of that provision or any other rights.
40. Entire Agreement
These Terms, together with the following policies, constitute the entire agreement between Enable Access and the Customer:

41. Governing Law and Jurisdiction

The courts of England and Wales shall have exclusive jurisdiction to resolve any dispute arising from or connected with these Terms, except where mandatory consumer protection legislation requires otherwise.
